Terms & Conditions

1. General

1.1 We do not supply goods on a demonstration basis unless otherwise agreed. If you are not sure about the product, we suggest you research it first before you make a purchase. We can offer knowledgeable and accurate advice – please feel free to ask us about anything you are interested in.

1.2 If the size of the product is critical, please make sure it will fit before you make a purchase. If the dimensions are not shown with the product specification, please contact us and we will provide you with the full dimensions.

1.3 In the event of any product specification change, or change in price, Palindrome Sports Ltd will inform you immediately as to the changes in specification or cost. You will then have the option to proceed with or cancel the order.

1.4 If a client wishes to change their order after the products have been ordered but before the products have been delivered to Palindrome Sports Ltd, or the client's premises, the client will be responsible for any cancellation or additional shipping costs which may occur.

1.5 If a client changes their mind after the product has been delivered, the client will be responsible for any return/re-delivery shipping costs.

1.6 When a Purchase Order has been received by Palindrome Sports Ltd for an estimate submitted, it is understood that the terms and conditions have been agreed by the client.

1.7 Palindrome Sports Ltd requires full and final payment upon delivery of any items that have been purchased for non account customers.

1.8 Palindrome Sports Ltd will not be responsible for the failure of equipment which has been altered by the client after delivery had been accepted. Any alterations you wish to carry out invalidate any warranty or responsibility on the part of Palindrome Spots Ltd.

1.9 Palindrome Sports Ltd shall not be liable for any economic loss or loss of profit (direct or indirect), or any indirect, special or consequential loss or damage howsoever caused, or any liability arising to any third party.

2. Palindrome Sports Ltd Obligations

2.1 Palindrome Sports Ltd shall perform any work carried out with reasonable skill and care and to a reasonable standard in accordance with recognised standards and codes of practice.

2.2 Palindrome Sports Ltd accepts all responsibility for the conditions of tools and equipment used in the performance of the work carried out and shall ensure that any materials supplied, as far as is reasonably possible, shall be free of defects.

3. Warranty and Repairs

3.1 In the event of a product failure, you are best advised to speak to Palindrome Sports Ltd first.

3.2 Most of our products come without any warranty expressed or implied. Please ask if the product you wish to purchase is covered under any warranty offered by Palindrome Sports Ltd.

3.3 Goods sent back to us as faulty but found to be fully working will be returned to you. Carriage charges will be at your expense. If you suspect a fault please call us first.

3.4 Goods that have been returned to us for faults which you believe to be covered by warranty but which are in fact not covered by warranty will be returned to you at your expense.

4. Clients’ Obligations

To enable Palindrome Sports Ltd to perform its obligations, the client shall:

4.1 Co-operate with Palindrome Sports Ltd.

4.2 Provide Palindrome Sports Ltd with any information reasonably required by Palindrome Sports Ltd.

4.3 Obtain all necessary permissions, licences and consents which may be required before the commencement of the services, the cost of which shall be the sole responsibility of the client; and

4.4 Comply with such other requirements as may be set out in the Proposal or otherwise agreed between the parties.

4.5 Should you wish to act as a selling agent for any of Palindrome Sports Ltd products, you will agree to all of Palindrome Sports Ltd Terms and Conditions by signing a Confirmation Agreement.

4.6 You, as the seller, will only sell to persons within your jurisdiction as set out by Palindrome Sports Ltd in the confirmation agreement.

4.7 You will pass on the contact details to Palindrome Sports Ltd of the person/purchaser to whom you are selling the product for authenticity purposes. Palindrome Sports Ltd reserves the right to contact any person/team who has been sold a Palindrome Sports Ltd product directly.

4.8 You will NOT sell to anyone outside of your agreed jurisdiction unless you receive authorisation in written paper or email format from Palindrome Sports Ltd.

4.9 The client shall not copy or reproduce any products that are the intellectual property/design of Palindrome Sports Ltd.

4.10 The client shall not copy or reproduce any products that Palindrome Sports Ltd have demonstrated or allowed the client to use on a trial basis.

4.11 Any drawings supplied by Palindrome Sports Ltd are protected under copyright laws and cannot under any circumstances be copied or passed onto third parties.

5. Right to Withdraw

5.1 Current legislation gives you the right to cancel the sale from up to seven working days from receipt of the goods, without penalty and without giving a reason. The following details would have to be complied with.

5.1.1 Cancellation must be in writing.

5.1.2 The goods must not have been unpacked or used.

5.1.3 The goods must not be damaged or soiled in any way.

5.1.4 Goods must be in their original packaging.

5.1.5 The cost of returning the goods would be at your own expense.

5.1.6 The goods must arrive back undamaged. Please consider insuring the goods before dispatch.

5.1.7 A refund would only be given when we have received the goods and the above points (1-6) have been complied with.

5.1.8 Variations to these conditions may apply – subject to mutual agreement.

6. Complaints’ Procedure

Your concern will be dealt with swiftly.

7. Payment Structure

7.1 In some circumstances Palindrome Sports Ltd will require part payment for work that has been ordered before the work commences. In such circumstances Palindrome Sports Ltd will make the client fully aware.

7.2 Once the product(s)/service(s) have been completed and products handed over to the client, payment for the outstanding balance will be required. If the product(s)/service(s) have been purchased on account our payment period is 30 days (not 30 working days).

7.3 The statutory right to interest under the Late Payment of Commercial Debts (Interest) Act 1998 will be applied if payment is not received according to our agreed payment terms. Interest is charged on a daily basis on the total value of the invoice at 8% above the Bank of England's base rate, which would commence the day after the invoice date above.

7.4 Any designs and equipment supplied by Palindrome Sports Ltd will remain the intellectual property of Palindrome Sports Ltd and may not be copied at any time unless you receive Palindrome Sports Ltd authority to do so. All goods supplied and equipment installed will remain the sole property of Palindrome Sports Ltd until paid for in full by the client.

8. Force Majeure

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside of its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

9. Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
